These Terms of Service ("Terms") are a legal agreement between you and Malli ("Malli," "we," "us," or "our") governing your access to and use of the themalli.ai website, any related products, services, software, and communications (collectively, the "Services"), including our SMS Messaging Program (defined in Section 5). By accessing or using the Services, joining our waitlist, or opting in to receive messages from us, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.
By using the Services you represent that (a) you are at least 13 years of age, (b) you have the legal capacity to enter into these Terms, and (c) your use of the Services will comply with all applicable laws and regulations. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
Malli is a software product that provides AI-assisted lead generation, organization, follow-up, and scheduling tools for real estate operators. Some features are in early access, may change, and may not be available to all users.
When you submit your email address through our waitlist form, you are signing up to receive waitlist and product update emails from Malli. You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email we send, or by emailing info@themalli.ai. Some transactional messages (for example, confirmations, security alerts, and account-related notices) may continue to be sent even after you unsubscribe from marketing emails, as permitted by law.
Some features of the Services require you to create an account or connect a third-party service (for example, your Google account via OAuth). You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any credentials. If you connect a third-party service, you authorize Malli to access only the scopes you explicitly approve on the consent screen. You may revoke that access at any time through your account settings on the connected service.
If you connect your Google account, you authorize Malli to access only the Google scopes you
approve on Google's consent screen — currently sign-in (openid, email,
profile), Gmail read and send, Google Calendar events, and per-file Google Drive
access (drive.file). Malli's access to and use of Google user data is described in
Section 6 of our Privacy Policy and adheres to the Google API Services User
Data Policy, including the Limited Use requirements. You are responsible for any email
Malli sends from your account at your direction or under rules you configure, and for
ensuring that such messaging complies with applicable law and all required consents. You may revoke
Malli's access at any time at
myaccount.google.com/permissions.
This Section 5 sets out the terms of Malli's SMS Messaging Program (the "SMS Program"). By providing your mobile phone number and affirmatively opting in (by actively checking the SMS consent checkbox on our website), you agree to these SMS Program terms in addition to the rest of these Terms.
The SMS Program delivers recurring marketing and informational text messages from Malli — for example, early-access announcements, product updates, feature releases, event invitations, and webinar reminders and access links. Messages may be sent using automated technology.
You opt in by visiting themalli.ai, entering your mobile phone number on the waitlist form, and actively checking the SMS consent checkbox (which is unchecked by default). Consent to receive SMS messages is not a condition of joining the waitlist, creating an account, or completing any purchase.
Message frequency varies. You can typically expect approximately 2–6 messages per month.
Message and data rates may apply based on your wireless carrier and plan. Malli does not charge you separately for SMS messages.
The SMS Program is available only to individuals who are 13 years of age or older with a valid U.S. or Canadian mobile phone number on a supported wireless carrier. By opting in, you represent that you are the account holder of the mobile number you provide, or that you have the account holder's permission to opt in.
Supported carriers include (but are not limited to) AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, Cricket Wireless, MetroPCS, Virgin Mobile, and most other major U.S. and Canadian carriers. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.
Your mobile phone number, your opt-in choice, and the consent record we store with it are treated as described in our Privacy Policy. In particular: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and SMS opt-in data and consent are not shared with any third parties (other than the subprocessors who deliver the messages, such as Twilio).
We may modify or terminate the SMS Program at any time, without notice. We may also remove or suspend any user from the SMS Program who appears to abuse the program, sends harmful or unlawful content to us, or whose number we believe is no longer valid.
You agree not to, and not to permit any third party to:
Some Malli features may take actions on your behalf based on the scopes and permissions you authorize (for example, drafting calendar events, organizing your inbox, or sending messages you have approved). You are responsible for reviewing automated actions, the outputs of any AI-generated content, and any communications sent on your behalf. Malli is not a substitute for legal, financial, tax, or other professional advice. You are responsible for ensuring that any outbound messaging you cause Malli to send on your behalf complies with applicable law and all required consents.
Some Services may be offered for a fee, on a free trial, or as part of a paid membership or plan. Fees, billing terms, and any applicable usage policies will be presented at the point of purchase or in a separate written agreement. Where you have a separate written membership or order form with Malli, that document controls fee terms over these Terms in case of conflict. All fees are non-refundable except where required by law or expressly stated.
The Services, including all software, content, logos, designs, and other materials made available by Malli, are owned by Malli or its licensors and are protected by intellectual property laws. Malli grants you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for your personal or internal business use in accordance with these Terms. You retain ownership of any content you submit to Malli (for example, free-text responses, data you connect via OAuth), and you grant Malli a worldwide, non-exclusive, royalty-free license to use that content as necessary to operate and improve the Services and to comply with applicable law.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MALLI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. MALLI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY MESSAGE WILL BE DELIVERED IN A TIMELY MANNER OR AT ALL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MALLI OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, EVEN IF MALLI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MALLI'S TOTAL CUMULATIVE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID MALLI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Malli and its officers, directors, employees, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms or any applicable law, (c) any messaging or other communications you cause Malli to send on your behalf, including any claim that such communications violate the TCPA, CAN-SPAM, CASL, or other communication laws, or (d) your violation of any rights of any third party.
You may stop using the Services at any time. You may revoke Malli's access to any connected third-party service at any time through that service's security or permissions settings. We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Sections of these Terms that by their nature should survive termination (including, without limitation, Sections 9–14) will survive.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. The exclusive jurisdiction and venue for any disputes arising out of or relating to these Terms or the Services will be the state and federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this Section limits any non-waivable rights you may have under the law of your state or country of residence.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through the Services or by email to users on our list. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
